Fort Myers, FL – September 15, 2022 – Unfair Advantage, a podcast series addressing the businesses’ challenges and opportunities, recently featured legal expert Diane Geller, Esq. of Fox Rothschild, LLP. This episode, “Legally Speaking Employment Advice,” hosted by Mona Hilton, CEO of Advantage Anywhere, brings to light significant legal aspects of staffing and employment in today’s post-pandemic work environment.

Geller provides useful insights on employee poaching where employers are bidding for their services. She says, “The great resignation wasn’t just a resignation from work; it was also a resignation to go to other employers. We’re seeing so much change where non-competes were strong and available but recently have been eroded due to federal, state, and local policies where those protections may or may not be available. So, the ability for employees to move around is growing greater and greater.”

 

Geller also discusses how companies can contend with employees’ growing demands. “Money relates to the quality of life in what employees are demanding. They want the ability to work from home. The attraction of employees and the type of position they are looking for – you really need to survey that and be responsive to what’s going to make you most competitive.”

 

As regulations and laws continue to evolve, Geller says, “More and more states are going to paid sick leave, and we’re waiting to see if the country as a whole goes to a paid family leave. So, companies need to make sure that their PTO, their vacation and sick time policies, will put them in compliance with state and local laws. Some of these state laws are really restrictive on employers.”

 

Employers are urged to re-evaluate employee agreements, company manuals, policies, and procedures. Geller points out, “They really do, because how are you going to deal with a remote employee? For example, if you have a remote employee, you need to understand that they are covered by worker’s compensation when they are working from home.”
